FBI breaks into dead gunman`s iPhone

The FBI has managed to unlock the iPhone of the San Bernardino gunman without Apple`s help, ending a court case, the US justice department says.Apple had been resisting a court order issued last month requiring the firm to write new software to allow officials to access Syed Rizwan Farook`s phone. But officials on Monday said that it had been accessed independently and asked for the order to be withdrawn.Farook and his wife killed 14 in San Bernardino, California, in December 2016.They were later shot dead by police.

The FBI said it needed access to the phone`s data to determine if the attackers worked with others, were targeting others and were supported by others.US officials said Farook`s wife, Tashfeen Malik, had pledged allegiance to the so-called Islamic State on social media on the day of the shooting. Is this the Israeli firm that hacked the phone? UN human rights chief backs AppleApple boss hits back at FBI conductLast week, prosecutors said “an outside party” had demonstrated a possible way of unlocking the iPhone without the need to seek Apple`s help.

A court hearing with Apple was postponed at the request of the justice department, while it investigated new ways of accessing the phone. At the time, Apple said it did not know how to gain access, and said it hoped that the government would share with them any vulnerabilities of the iPhone that might come to light.

Media captionApple`s CEO Tim Cook: “We have a responsibility to help you protect your data“On Monday a statement by Eileen Decker, the top federal prosecutor in California, said investigators had received the help of “a third party”, but did not specify who that was.Investigators had “a solemn commitment to the victims of the San Bernardino shooting”, she said.”

It remains a priority for the government to ensure that law enforcement can obtain crucial digital information to protect national security and public safety, either with co-operation from relevant parties, or through the court system when co-operation fails,” the statement added.Responding to the move, Apple said: “From the beginning, we objected to the FBI`s demand that Apple build a backdoor into the iPhone because we believed it was wrong and would set a dangerous precedent. As a result of the government`s dismissal, neither of these occurred. This case should never have been brought.”The company said it would “continue to increase the security of our products as the threats and attacks on our data become more frequent and more sophisticated”.

Alternate Title: FBI uses mystery method to break into gunman’s iPhone without Apple’s help

Analysis: Dave Lee, BBC North America technology reporterThe court case that had the US technology industry united against the FBI has for the time being gone away. Now this debate moves into more uncertain territory. The US government has knowledge of a security vulnerability that in theory weakens Apple devices around the world. To protect its reputation, Apple will rush to find and fix that flaw. Assuming it can do that, this row is back to square one. Therefore Apple has called for the matter to remain part of the “national conversation”, while the US department of justice says it will still try to use the courts to compel Apple and other phone makers to help with future investigations.Row just beginning
An Israeli newspaper last week reported that data forensics experts at cybersecurity firm Cellebrite, which has its headquarters in Israel, are involved in the case.Cellebrite told the BBC that it works with the FBI but would not say more. Its website, however, states that one of its tools can extract and decode data from the iPhone 5C, the model in question, among other locked handsets. The court order had led to a vigorous debate over privacy, with Apple receiving support from other tech giants including Google, Microsoft, and Facebook.FBI director James Comey said it was the “hardest question” he had tackled in his job. However, he said, law enforcement saved lives, rescued children and prevented terror attacks using search warrants that gave it access to information on mobile phones.

Facebook now used by half of world’s online users

According to the company, the number of people who use Facebook at least once in a month grew 13 per cent to 1.49 billion in the three months to the end of June this year
The number is equal to half of the estimated three billion people who use the internet worldwide.Of those users, it said well over half, 65%, were now accessing Facebook daily. The rise in monthly active users helped drive second quarter revenue up 39% year-on-year to $4.04bn (£2.6bn).

Mobile ads revenue was the biggest factor, accounting for more than three quarters of the total. In the US, the Facebook said people were now spending more than one out of every five minutes on their smartphones on Facebook.`Strong quarter`”They`re keeping people hooked. “But as well as keeping an eye on the short term gains they`re also keeping an eye on the long term so they`re future proofing themselves – it`s clear this is an organisational imperative,” Forrester analyst Erna Alfred Liousas told the BBC.Despite what Facebook boss Mark Zuckerberg said was a “strong quarter”, its shares fell more than 3% in after hours trading.Facebook shares, which are currently trading at around $97 a share, have risen 24% so far this year, easily beating the 7.9% rise in the Nasdaq over the same period. Analysts said the share price drop was linked to the high expectations for the firm, which typically tends to beat forecasts, as well as concern over its high expenses.

Alternate Title: Half of online world uses Facebook
Higher spendingFacebook said that costs and expenditures for the quarter had surged by 82% to a hefty $2.8bn.As a result, net income fell 9.1% to $719m – equal to 25 cents a share – but the firm said if various expenses were excluded earnings would have been 50 cents a share.Mr Zuckerberg said the costs reflected “ongoing investments and improvements” it had made, such as its new data centre in Texas, which had helped reduced crashes on the network. The social network giant warned in April that expenses could rise by up to 65% due to various investments in new staff, changes aimed at improving mobile revenue and the cost of improving products such as messaging service WhatsApp and photo-sharing app of Instagram. But it said expenses would now be lower than expected, at up to 60% higher.Facebook also highlighted the increasing importance of video, saying that usage continued to grow. And it said it would start selling its Oculus Rift 3D headset in the first three months of next year.”3D content is the obvious next thing after video.”Video will be huge, gaming will be huge. Once you start to get a critical mass we can get a social app which we are more specialised in,” said Mr Zuckerberg.Analysis: Dave Lee, North America technology reporter, San Francisco Mark Zuckerberg could be forgiven for cursing Wall Street under his breath. The social network`s share price has dropped – despite beating expectations in revenue, mobile advertising, growth and almost every other measure a web service can offer as a sign of good health. But investors and analysts don`t like the look of the company`s costs and expenses: $2.76bn for the quarter, up from $1.5bn this time last year. The company is investing heavily, in data centres and new methods of getting people online, which investors understand, but there is unease over the sheer size of the extra spending. But given Twitter`s problems earlier in the week, where it admitted user growth is desperately slow, the fact that Facebook, the world`s biggest social network, is still piling on new users that`s impressive.

Google rejects EU anti-trust allegations as flawed

Google has rejected the EU`s objections to how it displays shopping links in its search results as “wrong as a matter of fact, law and economics”.Europe`s competition commissioner accused the firm of abusing its dominance in search in April. Her intervention followed complaints from price comparison services that they were being unfairly disadvantaged by the prominence of Google`s own ads.The US firm has now filed its formal response.Google says its shopping service – which appears as a box of images and links displayed at the top or right-hand side of other results – benefits customers and businesses without unlawfully distorting the market.
And it rejects the EU commissioner Margrethe Vestager`s suggestion that it should show ads sourced and ranked by other companies within the facility. Its defence rests on three arguments:Fact: Google says that the amount of traffic it has directed to the relevant “aggregator websites” has risen by 227% over the past decade, rather than fallen. Moreover, a study it carried out covering four EU nations indicated that dozens of new price comparison services had begun operation, which it believes indicates that it has not choked off competition

Law: The search giant denies it has a duty to direct traffic to its rivals. It says its search engine should not be likened to the supply of electricity or gas, since there are many other ways to access the internet

Economics: Google believes the EU has failed to appreciate the dynamism of a market where consumers frequently search for goods via the likes of Amazon, eBay and social networks including Pinterest
`Artificially boosted ads`Google accounts for more than 90% of EU-based web searches.

The 28-nation bloc`s competition commissioner issued a “statement of objections” against the company, beginning a process that could ultimately lead to a large fine and compulsory measures to make it change its behaviour.”I`m concerned that Google has artificially boosted its presence in the comparison shopping market with the result that consumers may not necessarily see what`s most relevant for them, or that competitors may not get the commercial opportunity that their innovative services deserve,” declared Ms Vestager.A spokesman for Ms Vestager confirmed she had received Google`s reply.”We will carefully consider Google`s response before taking any decision on how to proceed and do not want to prejudge the final outcome of the investigation,” Ricardo Cardoso told the BBC.

FairSearch Europe, a lobby group that represents Microsoft and Expedia, among others, was one of the complainants against Google. It said it saw nothing in the search firm`s defence that would change its mind.”The Commission has properly defined the market into which Google has leveraged its overwhelming dominance in search, namely the shopping (price) comparison market,” said its spokesman Thomas Vinje.”Google has decimated competition in that market by preferencing its own product comparison service in its search results, and consumers have been harmed – and paid higher prices – because Google has cornered the shopping comparison market.”But, in a blog post, Google`s lawyer Kent Walker denies his firm is behaving in an anti-competitive manner.
“Showing ads based on structured data provided by merchants demonstrably improves ad quality and makes it easier for consumers to find what they`re looking for,” he said.”We show these ad groups where we`ve always shown ads – to the right and at the top of organic results – and we use specialised algorithms to maximize their relevance for users. “Data from users and advertisers confirms they like these formats. That`s not `favouring` – that`s giving our customers and advertisers what they find most useful.”
